Abstract

This work is part of a study we initially proposed on the spatial mobility of the Guarani and Kaiowá on the Brazil-Paraguay border. We start with an analysis of the new Migration Law, sanctioned in 2017 by the then President of the Federative Republic of Brazil, Michel Temer, who imposed several vetoes, reducing indigenous peoples' recognition of several of their rights, such as that in Article 1 , § 2, of the Migration Law, which recognized the right to free movement. However, in the course of the research, we found that our analysis should go beyond this point, as, in one way or another, bordering indigenous peoples also have their rights limited by national states. Therefore, we sought to find out how the Guarani and Kaiowá deal with the issue of borders, as well as carrying out a case study of the indigenous people of the Yshir/Chamacoco ethnic group who live in a region of Paraguay that borders Brazil. 6 We highlight part of the coming and going of these people and the main problems faced by them. The methodological basis was carried out with an interface in the disciplines of International Relations and Law, in addition to the other disciplines that help us to understand these issues. In addition to the bibliographical research, we carried out an analysis of Lawsuit No. 0000299-80.2019.8.12.0040, which is being processed in the District of Porto Murtinho/MS, in which indigenous peoples of the Yshir/Chamacoco ethnic group appear as defendants. In addition to this case, we bring to light other cases in which indigenous rights were interfered with by national States, and finally, we point out the need for the interlocution of Law with other areas of knowledge.
