Título: Discurso jurídico da educação especial: decisões do Tribunal de Justiça de Mato Grosso do Sul

Resumo: O direito à Educação Especial constitui-se num instrumento que garante aos sujeitos legitimados medidas diferenciadas, pautadas na igualdade material, que lhes propiciem condições para a apropriação do conhecimento científico, a promoção da autonomia e o pleno desenvolvimento humWAano. Tal direito é possibilitado, principalmente, por intermédio de políticas públicas, que, todavia, nem sempre são concretizadas. Desta forma, caso essa efetivação não ocorra, haverá a permissão para que o sujeito exija o seu cumprimento junto ao Poder Judiciário. Nessa direção, o presente trabalho objetiva analisar as ações judiciais emitidas pelo Tribunal de Justiça de Mato Grosso do Sul (TJMS) em relação ao direito à Educação Especial, de modo a destacar os discursos sobre a deficiência e sobre a educação dos sujeitos considerados Público-Alvo da Educação Especial (PAEE). Para o alcance da proposta, elencam-se os seguintes objetivos específicos: a) identificar os discursos sobre o sujeito com deficiência, problematizando-os a partir da definição de norma, dos processos de diferenciação e das abordagens médico e social; b) investigar o conjunto dos discursos sobre a educação do sujeito com deficiência, enfatizando a Educação Especial como um processo normalizador, cuja atuação se desdobra nas fases da institucionalização, integração e inclusão, configuradas por meio de dispositivos biopolíticos; c) analisar o discurso jurídico do direito à Educação Especial no âmbito do TJMS, esquadrinhando as decisões proferidas com vistas a problematizar os modos pelos quais as práticas discursivas de saber-poder produzem os sujeitos tidos como PAEE e os atendimentos educacionais especializados. O estudo fundamenta-se no método arqueogenealógico de Michel Foucault, problematizando práticas discursivas e não discursivas. Caracteriza-se como uma pesquisa documental, cujo corpus é constituído por 20 (vinte) ações do TJMS, ajuizadas entre os anos de 2010 a 2018. O tratamento desse corpus aproximou-se da analise do discurso de inspiração foucautiana, com ênfase em dois eixos analíticos: os sujeitos e as formas da Educação Especial. Os resultados apresentaram que o discurso sobre o direito à Educação Especial no Poder Judiciário não tem base probatória única e exclusiva do saber jurídico, mas também de áreas como a Medicina, Psicologia e a Pedagogia. Assim, conclui-se que a efetivação do direito à Educação Especial pelo Poder Judiciário utiliza-se de definições e posições de laudos e relatórios da área médica, educacional e psicológica, compatibilizando com normas legais autorizantes, ficando constatado, contudo, que a abordagem social da deficiência não está sendo prevalecente, bem como há produção de sujeitos ilegítimos como PAEE.
Abstract: The right to Special Education is an instrument that guarantees to legitimated individuals differentiated measures, based on material equality, that provides them conditions for the appropriation of scientific knowledge, the autonomy promotion and full human development. This right is made possible, mainly, through public policies, which, however, are not always fulfilled. Therefore, if this fact does not occur, there will be permission for the subject to demand compliance at Judiciary. In this direction, this work aims to analyze the lawsuits issued by the Court of Justice of Mato Grosso do Sul (TJMS) regarding the right to Special Education, in order to highlight the discourses about disability and education of subjects considered Special Education Target Public (PAEE). In order to reach the proposal, the following specific objectives are listed: a) identifying the discourses about the subject with disability, problematizing them based on norm definition, processes of differentiation and medical and social approaches; b) investigating the set of discourses on the education of the disabled subject, emphasizing Special Education as a normalizing process, whose action unfolds in the phases of institutionalization, integration and inclusion, configured through biopolitical devices; c) analyzing the legal discourse of the right to Special Education within TJMS’ scope, examining made decisions with a view to problematizing the ways in which the discursive practices of knowledge-power produce the subjects considered as PAEE and the specialized educational services. The study is based on Michel Foucault's archaeogeneal method, problematizing discursive and non-discursive practices. It is characterized as a documentary research, whose corpus is constituted by 20 (twenty) TJMS lawsuits, filed between 2010 to 2018. This corpus treatment approached to the Foucault-inspired discourse analysis, with emphasis on two analytical axes: the subjects and the Special Education forms. The results showed that the right to Special Education discourse in the Judiciary has no single evidential basis for legal knowledge, but also in areas such as Medicine, Psychology and Pedagogy. Thus, it is concluded that the implementation of the right to Special Education by the Judiciary uses definitions and positions of reports from medical, educational and psychological area, making compatible with authorizing legal norms, being noted, however, that disability social approach is not prevailing, as well as there is production of PAEE illegitimate subjects.
