dc.description.abstractAnalyzing the Brazilian juridical budget, which refers to delimitation of indigenous land, it is ascertained that is an unilateral acting of the government of this republic. In this scenery, the congressman Almir Sá, created the proposal of constitutional amendment, number 215 in 2000, which include, among the competence of national congress, the approval of land delimitation in areas traditionally occupied by indigenous, as well as ratification of those already approved. Occurs, that such offer has been faced, since it's creation, big obstacle by part of some individuais. Before Chis reality and considering the importance of this discussion related to the theme, this study aim present the main notes about constitutionally of Proposal of Constitutional Amendment 215/00.en
